Article 1 : Présentation de la Société Organisatrice

Clark Influence, ci après dénommé “ l’organisateur”, dont le siège social se trouve au 33 Rue La Fayette, 75009 Paris, France dont l’activité principale est le marketing d’influence, et 200 Rue Raymond Losserand, 75014 Paris  pour Atout France, organise un jeu concours sur les réseaux sociaux nommé : Le jeu : Escapade dans le Cantal. Ce jeu sans obligation d’achat sera hébergé sur le site d’Atout France et ses réseaux sociaux, ainsi que sur le compte de l’influenceur @lilia_rt . Ce jeu n’est pas géré ou sponsorisé par Instagram.

Article 2 : Participation

La participation à ce jeu est réservée aux personnes physiques majeures selon la loi française à la date du lancement du concours (soit âgées de 18 ans et plus), disposant d’une adresse e-mail valide, à l’exception du personnel salarié de la société organisatrice (Clark Influence et Atout France), de tous prestataires ayant collaboré à l’organisation du jeu (Ecolodge Ecrin d’Auvergne), ainsi que de leurs familles (même nom, même adresse), et des résidents du Québec, Canada. Les personnes n’ayant pas justifié de leurs coordonnées et identités complètes ou qui les auront fournies de façon inexacte ou mensongère seront disqualifiées, tout comme les personnes refusant les collectes, enregistrements et utilisations des informations à caractère nominatif les concernant et nécessaires pour les besoins de la gestion du jeu. La participation au jeu entraîne l’acceptation pure et simple du présent règlement, en toutes ses dispositions, des règles de déontologie en vigueur sur Internet, ainsi que des lois et règlements applicables aux jeux gratuits en vigueur sur le territoire. Le non-respect des conditions de participation énoncées dans le règlement entraînera la nullité de la participation.

Article 3 : Principe et modalités d’inscription

Pour participer, l’internaute devra effectuer les actions suivantes : 1. Suivre @ExploreFrance et @lodges_ecrindauvergne sur Instagram. 2. Liker la publication et tagger la personne avec qui vous souhaitez partir. 3. Bonus : partager la publication en story en identifiant @lilia_rt et @explorefrance Si les participants ne réunissent pas ces conditions, leur participation au jeu ne pourra pas être retenue.

Article 4 : Dotations

Le gagnant du tirage au sort se verra offrir : • 2 nuits pour 2 personnes à l’ecolodge Ecrin d’auvergne* • Petit déjeuner inclus • Apéritif offert et spa privatif *Valeur (610€) - selon disponibilités, d’octobre 2023 à juillet 2024. • Un crédit de transport allant jusqu’à 200€ (remis sous forme de bon cadeau)

Article 5 : Désignation du gagnant et modalités d’attribution des dotations

Le gagnant, ayant rempli correctement tous les champs de participation au jeu, sera tiré au sort automatiquement le 23 octobre 2023 à 18h (heure française). Le gagnant sera annoncé par @lilia_rt et contacté par @explorefrance en message privé. Le gagnant dispose de cinq (5) jours à la date du tirage au sort pour réclamer son lot. Passé ce délai, sans retour de mail de sa part, le lot sera perdu et ne pourra plus être réclamé sous quelque forme que ce soit. Un tirage au sort aura de nouveau lieu afin de désigner un autre gagnant. Les modalités d'attribution du lot seront identiques pour la ou les personnes tirées au sort par la suite.

Article 6 : Utilisation des données personnelles des participants

Les informations des participants sont enregistrées et utilisées par « Les organisateurs » pour mémoriser leur participation au jeu-concours et permettre l'attribution du lot. Les participants peuvent, pour des motifs légitimes, s'opposer à ce que leurs données personnelles communiquées dans le cadre de ce jeu fassent l'objet d'un traitement. Ils disposent également d'un droit d'opposition à ce qu'elles soient utilisées à des fins de prospection commerciale, en dehors de la participation à ce jeu-concours, qu'ils peuvent faire valoir dès l'enregistrement de leur participation en s'adressant par courrier à « L'organisatrice » dont l'adresse est mentionnée à l'article 1. Le gagnant autorise « Les organisateurs » à utiliser à titre publicitaire ou de relations publiques leurs coordonnées (nom, prénom), sur quelque support que ce soit, sans que cela ne leur confère une rémunération, un droit ou un avantage quelconque, autre que l'attribution de leur lot. Conformément à la Loi Informatique et Libertés du 6 janvier 1978, tout participant a le droit d'exiger que soient rectifiées, complétées, clarifiées, mises à jour ou effacées, les informations le concernant qui seraient inexactes, incomplètes, équivoques ou périmées en s'adressant par courrier à « L'organisatrice » dont l'adresse est mentionnée à l'article 1.

Article 7 – Modification du Règlement

Clark Influence et Atout France se réservent la possibilité de modifier sous la forme d’un avenant, à tout moment, le présent Règlement et à prendre toutes les décisions qu'elle pourrait estimer utiles pour l'application et l'interprétation du Règlement. Ils pourront en informer les participants par tout moyen de leur et se réservent également le droit de modifier, prolonger, écourter, suspendre ou annuler le Jeu, sans préavis, en raison de tout événement indépendant de sa volonté et notamment en cas d’événement constituant un cas de force majeure ou un cas fortuit. Les organisateurs se réservent en particulier le droit d’annuler tout ou partie du Jeu, s'il apparaît que des fraudes ou des dysfonctionnements sont intervenus sous quelque forme que ce soit, et notamment de manière informatique dans le cadre de la participation au Jeu ou de la détermination du gagnant. Ils se réservent, dans cette hypothèse, le droit de ne pas attribuer le prix aux fraudeurs. En effet, la fraude entraîne la disqualification immédiate de son auteur. La responsabilité des organisateurs ne saurait être engagée au titre de ce qui précède et les participants ne pourront donc prétendre à aucun dédommagement ou indemnité de quelque nature que ce soit.

Article 1: Presentation of the Organizing Company

Clark Influence and Atout France, hereinafter referred to as the "Organizing Companies", whose registered offices are 33 Rue La Fayette, 75009 Paris, and 200 Rue Raymond Losserand, 75014 Paris for Atout France, whose main activity is Influencer marketing and tourism development respectively, organizes an online game entitled "The game : “Cantal getaway:" (hereinafter referred to as "the game"). This no-purchase game entitled "GAME: “Cantal getaway: can be found on @explorefrance Instagram page and @lilia_rt, the influencer. This game is not managed, sponsored by or associated with Instagram.

Article 2 : Participation

Participation in this game is reserved for persons of majority legal age according to French law on the date of the launch of the contest (i.e., 18 years of age and older), with a valid e-mail address, with the exception of employees of the organizing company (Clark Influence & Atout France), all service providers who have collaborated in the organization of the game (Lodge Ecrin d’Auvergne ), and their families (same name, same address), and resident of Quebec, Canada. Persons who have not provided proof of their complete contact information and identity or who have provided it inaccurately or falsely will be disqualified, as will persons refusing to collect, record and use information of a personal nature concerning them and necessary for the purposes of managing the game. Participation in the game implies pure and simple acceptance of these rules, in all their provisions, of the rules of ethics in force on the Internet, as well as of the laws and regulations applicable to free games in force in the territory. Failure to comply with the conditions of participation set out in the rules will result in the invalidity of the participation.

Article 3: Principle and terms of registration

To participate, the Internet user must perform the following actions: 1. Follow @ExploreFrance and @lodges_ecrindauvergne on Instagram 2. Like the publication and tag the person with whom they want to go 3. Bonus : share the publication in story, tagging @lilia_rt and @explorefrance

If the participant's comment does not meet these conditions, their participation in the game cannot be taken into account

Article 4: Prizes

The winner of the draw will be offered: • 2 nights for 2 people in “Lodges Ecrin d’Auvergne” • Aperitif and private spa included • Breakfast included *Value (610€) - according availability, valid between October 2023 to July 2024. • A transport credit up to 200€ (distributed by gift card) This will include airline tickets or train tickets.

Article 5: Designation of the winner and methods of awarding the prizes

The winner, having correctly filled in all the participation fields in the game, will be drawn automatically on October 23rd, 2023 at 6:00 p.m. (French time). The winner will be announced by the influencer and contacted by private message by Explore France. The winner has five (5) days from the date of the draw to claim his prize. After this period, without a return email from him, the prize will be forfeited and can no longer be claimed in any form whatsoever. A draw will take place again to designate another winner. The terms and conditions for awarding the prize will be identical for the person or persons drawn subsequently.

Article 6: Use of participants' personal data

The information of the participants is recorded and used by "The Organizers" to memorize their participation in the contest and to allow the attribution of the prize. Participants may, for legitimate reasons, object to their personal data communicated in the context of this game being processed. They also have the right to object to their personal data being used for commercial prospecting purposes, outside of participation in this contest, which they can exercise as soon as their participation is registered by writing to "The organizer" whose address is mentioned in Article 1. The winner authorizes "The organizers" to use their contact information (name, first name) for advertising or public relations purposes, in any medium whatsoever, without this giving them any remuneration, right or advantage whatsoever, other than the awarding of their prize. In accordance with the French Data Protection Act of January 6, 1978, any participant has the right to demand that any information concerning him or her that is inaccurate, incomplete, ambiguous or outdated be rectified, completed, clarified, updated or deleted by writing to "The Organizer" whose address is mentioned in Article 1.

Article 7 - Modification of the Rules

Clark Influence and Atout France reserve the right to modify these Rules at any time in the form of an amendment and to take any decisions they may deem useful for the application and interpretation of the Rules. They may inform participants by any means of their own and also reserve the right to modify, extend, shorten, suspend or cancel the Game, without prior notice, due to any event beyond their control and in particular in the event of an event constituting a case of force majeure or a fortuitous event. In particular, the organizers reserve the right to cancel all or part of the Contest if it appears that fraud or malfunctions have occurred in any form whatsoever, and in particular in a computerized manner in the context of participation in the Contest or the determination of the winner. They reserve, in this case, the right not to award the prize to the fraudsters. Indeed, fraud leads to the immediate disqualification of its author. The organizers shall not be held liable for any of the foregoing and participants shall not be entitled to claim any compensation or indemnity of any kind whatsoever.
